Council cool with cannabis store applications

City of Cranbrook council last night unanimously agreed to support applications for two proposed non-medical cannabis retail stores.

Section 33(1) of the Cannabis Control and Licensing Act prevents the Liquor and Cannabis Regulation Branch (LCRB) from issuing a cannabis retail store license without a positive recommendation regarding the license application from the local government or Indigenous nation.

Council recommended support for an application from Margaret Ann Sissons, Clifford Frank Sissons, ET AL (EK Cannabis) for a proposed non-medical cannabis retail store at #12 – 9th Ave South, with operating hours from 9 a.m. to 11 p.m., seven days a week.

Council’s support was noted in an Office of Innovation and Collaboration report by planner Rob Veg: “The property is located in Cranbrook’s commercial downtown. No negative impacts on the community are anticipated if the application is approved as the use is permitted in the C-1, Community Commercial Zone and is located among other commercial retail and food and beverage establishments; The view of property owners/occupants within approximately 30 metres of the proposed location were gathered by way of written invitation by the city to comment on the Application within two weeks of the date of the correspondence.”

One written submission supporting the application was received.

Council also recommended support for an application from Clarity Cannabis BC Ltd. for a proposed non- medical cannabis retail store on property located at 1325B Cranbrook Street North, with operating hours from 9 a.m. to 8 p.m. Monday to Sunday.

Council’s support was noted in an Office of Innovation and Collaboration report: “The property is located on a highway commercial corridor and is zoned C-2, Highway Commercial Zone. No negative impacts on the community are anticipated if the application is approved as the use is permitted in the C-2, Highway Commercial Zone and is located among other commercial retail and food and beverage establishments. The view of property owners/occupants within approximately 30 metres of the proposed location were gathered by way of written invitation by the city to comment on the application within two weeks of the date of the correspondence.”

Two written submissions were received noting concerns with respect to the proposed application.

“Further, staff received verbal comments on January 4 from Rick’s Meats that they do not support the application due to the parking issues and having underage staff. The applicant has contacted Rick’s to discuss addressing concerns; however, it appears that no resolution has been made at this time. The applicant has provided additional comments regarding the site and parking and has confirmed that he is “willing to help in any way reasonable,” Veg reported.

City administration recommended council “provide a positive recommendation regarding the proposed license location and further encourage dialogue between the parties to try and find common ground and a resolution to the parking matters between the properties.”

After a few questions council Jan. 7 agreed to provide a positive recommendation from the city.
