Land use change allows for Parnaby Road development
City of Cranbrook council July 10 adopted Official Community Plan (OCP) and zoning amendments for a four hectares Parnaby Road property, allowing for the proposed development of 78 dwelling units.
The proposal application received from Haworth Development Consulting on behalf of the owners, Oasis at the Dunes Ltd, sought to amend the city’s OCP by making changes to the St. Mary Neighbourhood Plan and changing the land use designation. The proposed amendments also facilitate rezoning of the property to allow residential development.
Zoning Amendment Bylaw No. 4081, 2022 – Parnaby Road was approved by the Ministry of Transportation and Infrastructure (MOTI) on June 29, with the condition that the applicants enter into a restrictive covenant between the developer, MOTI and city.
The covenant stipulates that highway intersection improvements at Parnaby Road and Highway 95A be completed prior to granting final approval of a phased strata subdivision plan or grant occupancy of any of the buildings until the developer has completed intersection improvements or has entered into an agreement with the province and city, including payment of security in the amount of 125% of the cost of the improvements for the upgrades, a city Engineering and Development Services report outlined.
“Due to the nature of this development and the impacts to the provincial highway, the city will have to take a proactive role to ensuring the conditions of the covenant are being satisfied through our development approval process.”
In addition to the covenant required by MOTI, the applicants have also registered covenants per their commitment during the bylaw approval process to restrict short-term rentals, provide notice of potential nuisances from nearby agriculturally zoned lands and that no building permits or occupancy will be granted until the lands are connected to the city’s sanitary sewer system or has provided security in the amount of 125% of the cost required for connection to the sewer system, the city report stated.
“City staff noted that since the time of original application, the status of the Shadow Mountain Local Area Services was not known; however, construction of the sewer system is now taking place.”
The intent of the proposed bylaw changes is to permit development of duplex and townhouse units on the property consisting of approximately 50 duplex units and 28 townhouse units with an overall density of 20 units per hectare (eight units per acre).
The development would be accessed from Parnaby Road and serviced with municipal water and sewer.
