Fernie Council Connection

The following is a synopsis of what occurred during the Nov. 28 City of Fernie council meeting.

1. AGREEMENTS, LICENCES PERMITS & POLICIES

No. 562570 – Best Western 1622 – 7th AvenueCouncil issued the permit to vary the minimum side yard setback to allow the structure referred to as the “Covered Entry” as it was not constructed in accordance with the side yard setback requirements as set out in Section 4.2.10.4 of the Zoning Bylaw COUNCIL PACKAGE

1.2 Development Variance Permit Application No. DVPA-396  Council approved Development Variance Permit Application No. DVPA-396 and gave notice of their intention to consider the issuance the Permit to vary the minimum rear yard for an existing accessory building only, along a portion of the west property line as the existing accessory is proposed to be converted into a secondary detached dwelling unit.

2. BYLAWS

2.1 Bylaw No. 2303 Zoning Bylaw No. 1750, Amendment Bylaw No. 184, 2016Council approved the application from Fernie Distillers Inc. to amend City of Fernie Zoning Bylaw No. 1750 and gave it first and second reading with the application to come forward to a public hearing.

Fernie City Hall Xmas2.2 RDEK Bylaw Referrals.  Bylaw No. 2741 – A bylaw to amend RDEK Elk Valley Official Community Plan No. 2532, 2014 & Bylaw No. 2742 – A bylaw to amend RDEK Elk Valley Zoning Bylaw No. 829, 1990 – Foothills Silva Culture Inc. (6393 Highway No. 3 (Former Mainroads Contracting Yards). Council offered its support of the application submitted by Foothills Silva Culture Inc. that would amend RDEK – Elk Valley Official Community Plan Bylaw No. 2532,2014 to re-designate and rezone the subject Lot from RR, Rural Resource to I, Industrial and from PG-3, Utility and Public Works Zone to MG-1, Light Industrial Zone, respectively and further, council recommends that the RDEK Board of Directors give first and second readings to Bylaw No. 2741 and Bylaw No. 2742 as long as all the stipulations are met prior to adoption as outlined in the attached staff report. 2.3 Business Licencing and Regulation Bylaw No. 2028, 2006, Amendment Bylaw No. 2311, 2016 was adopted. This amends the Business Licencing and Regulation Bylaw No. 2028 to allow businesses that provide mobile services to apply for an Inter-Community Business Licence (ICBL) in accordance with proposed Inter-Community Business Licence Bylaw No. 2308.

2.4 Inter-Community Business Licence Bylaw No. 2308, 2016Council adopted Inter-Community Business Licence Bylaw No. 2308, 2016. This bylaw establishes an inter-community business licensing scheme to regulate mobile businesses operating within the boundaries of each Participating Municipality.
