Fernie Council Connection

The following is a breakdown as to what occurred during City of Fernie Council’s regular meeting on Oct. 27.

1. AGREEMENTS, LICENCES PERMITS & POLICIES

1.1 Royal Comete Hotel & Bar’s (LCLB) Temporary Change application. Council supported the administrative decision to object to the temporary change to extend the hours of operation for the Royal Comete Hotel & Bar to 4 a.m. on December 6, following the Appeal Hearing. Council heard from the appellants prior to upholding section 1.6 the Municipal Liquor Licence Policy which prohibited such extensions.

1.2 Max Turyk Community Centre Lease Agreement with the Fernie Child Care Society. Council authorized the Mayor and Clerk to execute the lease agreement between the City of Fernie and the Fernie Child Care Society, for a portion of the Max Turyk Community Centre comprising 1,487 square feet (Nov. 1/14 to Sep. 30/19) at an annual rent of $14,870.

FernieArena1.3 Fernie Memorial Arena Lease Agreement with the Fernie Ghostriders Junior Hockey Team. Council authorized the Mayor and Clerk to execute the lease agreement between the City of Fernie and the Fernie Ghostrider Junior Hockey Team, for a portion of the Fernie Memorial Arena comprising 1,248.3ft2 (Nov. 1/14 to Oct. 31/16) at an annual rent of $1.

1.4 Fernie Memorial Arena Proposed Lease Agreement with the Fernie Curling Club. Council authorized notice of its intention to dispose of City’s property via a Lease Agreement with the Fernie Curling Club, from November 15 to April 15, 2015 for a monthly lease rate of $1,440.

2. BYLAWS

2.1 Zoning Bylaw No. 1750, Amendment Bylaw No. 169, Bylaw No. 2258, 2014 was adopted. The bylaw changed the zoning at 642 – 8th Avenue from R1-Single Family Residential to R1SL- Single Family Residential Small Lot.

2.2 Zoning Bylaw No. 1750, Amendment Bylaw No. 170, Bylaw No. 2262 was adopted. The bylaw changed the zoning at 822 – 6th Avenue from R1 – Single Family Residential to R1SL – Single Family Residential Small Lot.

2.3 Official Community Plan Bylaw No. 2231, Amendment Bylaw No. 1, Bylaw No. 2213, 2014 and Zoning Bylaw No. 1750, Amendment Bylaw No. 148, Bylaw No. 2216, 2014 (Cedar Valley Neighbourhood) received first and second readings referral to a public hearing. The bylaws propose to change the land use of the subject lands from Residential to Natural Open Space and the Comprehensive Development Zone Four from the mixed use of R2–Duplex Residential, R2–Duplex Residential “Small Lot”, R3–Medium Density Residential, R3–Medium Density Residential “Affordable” and R4–Multiple Family Residential to RR–Rural Residential, R1B–Single Detached Plus Residential, R4–Multiple Family Residential (High Density) and OS1–Open Space.

2.4 2014-2018 Five Year Financial Plan Amendment Bylaw No. 2265, 2014 received first three readings. This amendment proposes to reallocate current funding from the downtown surveillance cameras and to increase capital works expenditures and the East Kootenay Energy Diet subsidy. Council encourages the public to review copies of the bylaw amendment and staff report on the city’s website at www.fernie.ca and if desired, to make representation to council at the November 24 meeting either in person or in writing.

3. OTHER INFORMATIONAL ITEMS

3.1 Fernie Family Housing Society (FFHS) Veneto Place, Unit 102 -1002 1st Avenue. Council authorized the discharge of the Affordable Rental Covenant registered in favor of the City on Veneto Place Unit 102, 1002 1st Avenue owned by the Fernie Family Housing Society.

cofbarrier3.2 Liquid Waste Management Plan. Council endorsed the Liquid Waste Management Plan and financial commitments and authorized staff to forward the plan onto the BC Ministry of Environment for approval.

3.3 Notice of Intended Disposition of Municipal Property to BC Hydro and Power Authority. Council authorized notice of the proposed disposition (sale), of approximately 0.75 acres of municipal property for the sum of $175,000 to BC Hydro to accommodate an expansion of the Fernie Substation.

3.4 The December 1, 2014 COTW meeting was cancelled.

3.5 Council agreed to continue to fund the Access Guardian Program from 2016 – 2020. The program provides a backcountry Access Guardian, hired by the Conservation Officer Service, to perform on-the-ground education to backcountry users and stakeholders in order to increase compliance relating to backcountry access management issues in the Electoral Area A or the Regional District of East Kootenay (RDEK). The funding contribution by the City of Fernie towards this program is $10,000 per year.

3.6 Fernie Alpine Resort – New Year’s Eve Fireworks Display (RMI Funding Request). Council gave direction to staff to bring forward a partnering agreement for consideration that provides $1,000 for fireworks to the Resorts of the Canadian Rockies (RCR) for the New Year’s Eve fireworks for the 2014, 2015 and 2016.

4. UPCOMING MEETINGS AND OTHER NEWS

4.1 Next Regular Meeting and Committee of the Whole (COTW) is scheduled for November 10. COTW to commence at 10 a.m. and the Regular Council meeting at 7 p.m. Council meetings are streamed live or can be viewed on-demand on the city’s website or watched on Shaw TV Channel 10 at 3:30 p.m. on Tuesdays and 11 a.m. on Thursdays.

Please note that there may be some interruption to the broadcasting on Shaw during the election campaign period. Regular programming (if interrupted) will resume following the election.

FernieCenotaph4.2 Stat Holiday Closures. City Hall, Fernie Aquatic Centre and the Fernie Memorial Arena will be closed on Tuesday, November 11 for the Statutory Holiday (Remembrance Day).

4.3 Remembrance Day. Remembrance Day parade and Cenotaph Ceremony at the Court House grounds on November 11, honouring sacrifices of the past.

4.1 Job Opportunity – Casual Flaggers. The city is looking for Certified Traffic Control Persons for casual work this winter. Applications will be accepted until November 10.
